I honestly didn't give a whole lot of thought to it at first. I think the program that I use to edit videos strips the id3 tags and re-renders the audio tracks so youtube may not be able to discern who's music it is and whether or not they are on the list that gets "muted".
The short of it is, or at least as I can best understand it, is that since my video is not for commercial purposes the ASCAP will not come after me. Prior to them reaching me, they will reach out to youtube or whoever is actually hosting the video file. So far youtube, read Google, has been taking up the legal battle and paying their attorneys in addition to fines totaling over 1 million. So for now I am cool with embedding music in my videos since I have no intention on trying to make money off my pathetic attempts, and if any action is taken it would likely be a cease and desist. Above that they can't draw blood from a turnip. I'd just have to go rouge and live off nuts and berries, and of course fish all the time.
I look at it as I am promoting a musician that I like and enjoy. Maybe others with like and enjoy them and purchase some of their intellectual property. Sooner or later the industry will either catch up with technology or go the way of the dinosaur. Guess what there will be someone that will fit what ever the new model will be to take their place.
